The article analyzes the issues of legal regulation of contractual relations in the context of the digitalization of the public procurement process. The aim of the study is to theoretically determine the civil law nature of the electronic public procurement contract and to determine ways to improve national legislation based on foreign experience. The models of the European Union, South Korea, and Kazakhstan were studied using comparative-legal and systemic-structural analysis methods. As a result, the principle of equating electronic contract, electronic signature and digital identification to written form is justified, and the need for full digitalization of the procurement cycle is shown. The article concludes with specific proposals aimed at improving the Civil Code and public procurement legislation.
