数字技术的深度普及与迭代更新，全面重塑了当代社会的生产生活模式与风险生成形态。相较于传统网络犯罪，数字时代衍生的新型犯罪呈现出产业化分工、非接触式实施、证据电子化留存、危害跨域辐射蔓延的全新特征，涵盖电信网络诈骗、虚拟货币跨境洗钱、人工智能深度伪造犯罪、数据安全侵害犯罪等多元犯罪样态。此类新型犯罪突破了传统物理犯罪的时空边界，对我国根植于物理社会构建的传统刑法教义体系、共同犯罪认定规则、主观明知推定标准形成系统性冲击，在司法实践中长期面临跨境电子证据调取难、数字证据鉴真难、涉案虚拟资产追缴难等现实司法梗阻。当前学界围绕数字犯罪治理形成立法扩张与解释优化两大研究路径，但现有研究存在同质化叙事突出、实务针对性不足、分层治理机制缺失等问题。本文立足于现行刑事法律体系，依托最高人民法院、最高人民检察院发布的典型案例开展类型化考察，梳理数字新类型犯罪共通的法律适用困境，坚持刑法谦抑性原则与罪刑法定基本原则，依托近年学界主流研究成果，通过教义学规则调适、司法证明规则细化、跨境司法协作完善、行刑衔接机制重构，能够有效摆脱数字新类型犯罪的规制困境，实现惩治数字犯罪、保障数字安全与赋能数字经济良性发展的动态平衡。
